EXPRESS CONSENT AND WAIVER OF THE 14-DAY REFUND RIGHT
Pursuant to Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) regarding the supply of digital content not supplied on a tangible medium:
By clicking “Pay Now”, “Purchase”, or otherwise initiating the download of the Digital Assets, you explicitly consent to the immediate commencement of the performance (delivery) of the contract. You hereby acknowledge and agree that once the digital delivery or download process has begun, you forfeit and waive your legal 14-day right of withdrawal and are no longer entitled to a refund.
Due to the immutable nature of digital goods, which cannot be returned or revoked once access has been granted, all sales are final.
- Limited Intellectual Property Licence & Ownership
When you purchase a Digital Asset from Sparkclipassets, you are buying a licence to use the asset, not the asset itself.
Retention of Ownership: SWITCH GROUP LIMITED retains full, exclusive, and absolute ownership, copyright, and intellectual property rights over all source code, software, asset packages, artwork, visual elements, graphics, and music tracks contained within our products.
Granted Licence: You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Digital Assets in your personal or commercial video productions.
Strict Prohibitions: You are strictly prohibited from:
Extracting, isolating, or reverse-engineering any individual source code, artwork, or asset from the package.
Copying, reselling, sub-licensing, renting, redistributing, or sharing the digital files with third parties.
Using the assets to create competing products, stock elements, or standalone templates for resale.
- Dispute Resolution & Governing Law
As a registered New Zealand business selling exclusively to consumers in the European region, any contractual disputes will be governed by the laws of New Zealand, without prejudice to any mandatory consumer protection rights you hold under EU local laws that cannot be waived by contract.
